Legal Question in Immigration Law in Massachusetts

I have been denied asylum based on religious persecution while my brother was granted by a different judge based on the same reasons. The only difference was that he was a victim of past persecution while I wasn't because I was too young at the time.

I filed an appeal and I'm waiting for my briefing schedule to arrive.

The question is, how can I use brothers asylum approval to my advantage? is there a case-law with a similar situation?

You can mention your brother's case, but the judge is not obligated to approve your asylum because your brother's application was approved. I actually see this situation quite often.

When the BIA briefing schedule will arrive, your lawyer should prepare a Brief and submit it to BIA for reconsideration.
