Legal Question in Immigration Law in Massachusetts
My husband had filled the I-485 on my behalf we are now seperated due to domestic violence issues in our marriage. I am waiting for I-360 application to come in from the mail so I can petition for myself, I already got the EAC. However I received a letter for our interview (My husband and I`s ) for Febuary 7th. I`m afraid to go to the interview becasue my husband is not going to come with me since our seperation I have been living in a domestic violence shelter I am also 6months pregnant with his chil. What our my best obtions? Do you have any advice?

Sorry to hear about your troubles. Unfortunately, you can't miss the adjustment of status interview and can't go there by yourself (your applications can be denied). You should consult a lawyer ASAP. If you plan to file the I-360, it's possible to ask the local USCIS office to hold your adjustment application in abeyance pending decision on your VAWA petition. An experienced immigration lawyer would know how to do it.
There is no need to wait for any forms to arrive by mail. The I-360 can be downloaded at www.uscis.gov . However, you need to submit supporting documents with your application (not just an application alone). It's always advisable to have a professional legal help with a VAWA self-petition. You may want to inquire at the shelter where you stay, they may have local Free legal services or Catholic Charities contacts.
