Legal Question in Insurance Law in Massachusetts
accident question
i was rear ended by a mack truck, luckily i did not get seriously hurt (just a few aches and pains )my problem is that my 2003 explorer is totaled and my insurance says i can only get about 5k for it .. i have had this truck for 5yrs, it's all paid for, and had not a scratch on it . it did have 100k miles, but i was confident i could get another 75k . is there someway i can dispute this and get a little more for my truck why do i have to go and finance another car , when i did nothing . i feel the trucking company should just give me a complete replacement car.. what are my options here?? thank you very much

I am sorry to hear about your Massachusetts truck accident. You either have to negotiate with the trucking companies insurance adjuster to get more money for your vehicle or file a lawsuit in Court to obtain more damages. Generally you are only entitled to the book value for the automobile. If you have your own collision insurance you can seek to put a claim with them but then would have to pay the deductible. Since, there are no personal injuries involved in this case it probably would not be cost effective to hire a personal injury or auto / car accident lawyer.
