Legal Question in Insurance Law in Massachusetts

Claim

I moved my car from CA to MA, the carrier took 3 times the time agreed to bring the car to MA. On top of it they damaged the car. I had taken the movers insurance from the carrier. Now when I contacted them for claim they replied that they hired a secondary company for shipping the car and I need to deal with them. I got the contact info and submitted the claim. After going through lot I finally get the claim to submit to their insurance. Now I have been calling and chasing them for the status of my claim but everytime I call they give a number to call and after 10 attempts I get someone to reply� today I talked with someone in claims department and the person said that if the damage is below $1000 the service provider has told them that they will handle at their end. When I call the service provider they deny to take the claim.

I have the concern paper signed by the delivery person confirming the damage. i also have pictures of the damaged vehicle and as per the process i got quote for the repairs and has send to the company. But inspite of submitting everything just dont get hold of this people to pay for their liability.

I would appreciate if someone can advise me what should I do in order to get this resolved.

I have dealt with these type of persons several times. My best advice to just to sue them. They will never respond until you get tough with them. If you have any questions or concerns, please feel free to let me know.

You could just sue them and let them explain to the court why they have refused to pay the claim. Mass. General Laws chapter 176D makes it a consumer fraud for an insurer to fail to act in good faith when resolving a claim and entitles the consumer to double or triple actual damages as well as reasonable attornye's fees.
