Legal Question in Insurance Law in Massachusetts
How do I find out who is the beneficiary of my fathers life insurance if we cant locate copies of it? We called the insurance company but they wont release the information. I was told by a friend that the insurance company is supposed to tell the executor of the will, he just has to show papers that he's executor of the will is that true?

The answer to this question is complex. Any insurance company paying amounts due under a life insurance policy is usually going to be paying out hundreds of thousands of dollars. Typically, thus, the insurance company may be reluctant to pay in cases where its liability under the policy is unclear. To that end, be careful about what you say to the insurance company, as the relationship may turn adversarial.
An executor or administrator empowered by a Court to deal with an insurance company should be able to obtain a copy of the policy. However, my first choice would be to have the executor empower an attorney to deal with the insurance company on his or her behalf.
