Legal Question in Insurance Law in Massachusetts
I was hit by a car after I got off my bus. I was crossing the street (not at a crosswalk) and the neither me nor the driver saw one another. So far as I know, I was the only one in violation (i.e. by jaywalking). I hit the car and broke the mirror. I sustained minor injuries, but did not require medical attention. When the police came to do the report, I told them I was at fault (for jaywalking), which was put in the report. II may have to have MRI work done for my leg. Later, I was contacted by the driver's insurance demanding payment for the damage to the car. They claim that I am fully liable for the damages. Is this true? If so, what determines liability?
