Legal Question in Personal Injury in Massachusetts
My 23 year old son was in a terrible car accident, he has auto insurance uner my boyfriend and lived with us at the time of the accident in MA. There was another person that was seriously injured in the car. The other person has a lawyer that sent my boyfriend and I a letter to submit my home owners insurance to them within a timely manner or I will be held responsible for all the fees from the accident. I do not own the house or have home owners insurance, my boyfriend does and the insurance company laughed and said to ignor the lawyer, he's not repsonsible. Can I be held financially resonsible for the car accident? This happened in a different town and I was sleeping at home in bed at the time of the accident.

I'm sorry to hear about the accident.
You should probably retain counsel to advise you. I am curious who owns the car, as that may make a difference. I think you should notify your insurance company and retain counsel in order to fully protect yourself, even though it sounds as though you would not be liable.
The certainty you seek regarding your rights and responsibilities are something lawyers have special training, experience and education in order to determine, and they sell their time and expertise by the hour. If you needed an answer to a complex math problem you would hire a mathematician. Similarly if you need to know this to sleep at night you should hire counsel. Understand even if you pay for a few hours of a lawyer's time to sit down with you, obtain all the facts, review the insurance policies and the letters and the accident report and to absorb and understand all the facts, and then to review the law, you will only get an opinion and no lawyer is going to guarantee that you could not be held liable. Best luck. Regards, JBS
