Legal Question in Personal Injury in Massachusetts

automobile accident

I was in an accident on 9/26. I was making a left hand turn and the other car was speeding down the rode and hit me. My insurance is saying because it was head on and because i was cited it's my fault and her speed doesn't matter. What should I do? The other ladies insurance company sent my a letter to call them should I? My injuries included a head laceration that I had to have 20+ stitches in my forehead and I have to see a plastic surgeon. I am 19 years old and have never been in an accident or had a ticket.

From what you are saying, it sounds as though you may be at fault for causing the accident. Because you were crossing the other car's line of travel, they did have the right of way.

However, if they were negligent in speeding, they may share in the liability for the accident. You need to consider what proof you might be able to offer in support of your allegation that the other driver was negligent.

You should not speak with the other side's insurance company until you have spoken with an attorney. They may attempt to give you some payment in exchange for signing a release of your rights. You really want to speak with an attorney before you do this, and you should not provide them with a recorded statement.
