Legal Question in Real Estate Law in Massachusetts

Home taken from health care facilities

I live with my elderly mom in the house I grew up in and help her pay bills for our home and help her with her medical problems. I pay for all large purchases needed and any maintenance on the home. I've always given her cash to pay for expenses. What is the best way to assure that if she goes into a healthcare facility in the future that I won't lose this house? She has me on her will to get the house if she dies, but is there a law that states that since i have lived here for 47 years and helped her finance the home for the last 30 years that i will not lose it? Thank you

Re: Home taken from health care facilities

You should contact an attorney to help you do this correctly.

She could gift you the home and retain a life estate. However, in doing this you have to make sure that she does not lose medicaid coverage. It depends on her age financial condition and other things. there are other ways as well to do this.

You need to do this with an attorney who is up to date with the laws governing eldercare.
