That depends upon the fact pattern. They way you have put the question, in 11 words, doesn't begin to address the possibilities. I would normally talk to someone about this for 20 or thirty minutes. It depends on the length of marriage, availability of other assets to satisfy a property division, and a host of other facts, especially whether there are minor children living in the home.
