Legal Question in Real Estate Law in Massachusetts

Roommate will not pay rent and will not move out

Roommate refuses to pay rent (stopped working) and refuses to move out. Landlord says she will sue if I do not cover full rent. Both of us signed the lease. Landlord will not allow early termination. Roommate filed a restraining order(although he assaulted me).

7 mo left in the lease.

Not sure what options are... pay full rent, do not pay and go through court, sue roommate for rent not repaid...

Roommate will not pay rent and will not move out

YOu have a complicated legal mess.

1. The restraining order and any action arising out of this is something separate and apart from your lease obligation.

2. If the landlord sues you for the rent and not the co-tenant, you can, in the same action, sue the co-tenant.

Given the complications, you should really sit with an attorney to guide you through this situation.
