Legal Question in Traffic Law in Massachusetts

car accident question

Hi I was wondering if you could help me with this case, because I am young and I dont really know how to handle legal situations. I was in a car accident two nights ago. I was driving through an intersection going straight, and the car I hit was coming in the other direction, taking a left turn, and turned infront of me. Both of us had a green light, the front of my car hit the front right corner of his car. In this situation I know I had the right of way, because I was going straight and he was making a turn. However, the officer that came to the scene said that it was 50/50 because atleast one of the witnesses said I was going too fast. I am trying to fight this because I do not have collision insurance for my car and the damages are much too expensive for me to afford. What I am wondering is, is it fair to go by what the witnesses said, when they have no proof I was speeding or how fast I was really going? Shouldn't he automatically get blamed, because I had the right of way and he should have checked to make sure noone was coming? Please let me know what you think I should do. thank you!

If you are found 50% at fault and you are surcharged as a result you can appeal the surcharge and the fault to the division of insurance where you will have a hearing and can present evidence.
