Legal Question in Wills and Trusts in Massachusetts
If all parties sign the General Assent form on an estate, what is the next step?
2 Answers from Attorneys
The next step in probating an estate in Massachusetts will depend entirely on the estate. Is there a will? Is there no will? Does the estate qualify for voluntary administration? Is there real estate to be sold? Has an inventory been prepared and filed? More information is necessary to properly advise you. If you need legal specific legal advice, I recommend that you retain counsel.
What are you assenting to? The appointment of an executor or administrator? The allowance of an account?
Generally, if all the interested parties assent to a proposed action, the petitioner (or his attorney) will file the assents with the Probate Court and the action will be allowed.
