Legal Question in Workers Comp in Massachusetts
At the end of his rope
My husband was hurt at work 3 yrs 7 months ago, sustained severe shoulder injury when he fell into a 4 foot trench in which the side gave way, crushing his shoulder between concrete and a 200 pound cast iron pipe. He has had two surgeries to repair labrum, crushed clavical, bicep tendon, rotator cuff and remove bone spurs. According to three surgeons he is at a medical end, who all agree he has 50% loss of function in his right, dominent shoulder. He is at settlement point with the insurance company and has no idea what is a reasonable amount to expect. He needs this to end, but is so afraid of selling himself short or asking for too much. He has--name removed--three years 7 months of wages, was one semester away from having his plumbers license, and now has to find a new career with restrictions of no lifting over 15 lbs, no repetitive motion, no overhead work above 90 degrees. He is going to be in pain and on medication for the rest of his life. What is a reasonable amount to expect as a settlement? Any advise will be greatly appreciated.
