Legal Question in Appeals and Writs in Michigan

Appealing a murder conviction

My son's father was just convicted of 1st degree murder. All eveidence was cicumstantial. In fact first they read a NOt- guilty on all chargres then switched the verdict. It's not complicated. Even the police who testified said the eye witness they had was a liar. The eye witness llied to the police three differnt times about everything. Made up descriptons of 3 people. Went back to the police a month after the supposed drive-by shooting. Even the medical exz. said the shots were not more then 3 feet away. Which is crucial because he lied about who he was with that day at the time of the shooting. He said 15 to 20 shots were fired and not ONE bullet was found or shell ( even though not all guns leave shells ) HE said he was hiding behind a car and the car he was behind took most of the shots. Where is that car? He doesn't know. I can't believe the jury found him guilty when the witness admitted on the stand he lied to the police. The last note that was sent to the dep. said 9 Not guilty 3 guilty. LIFE in prison for a 25 year old (new father of our 10 month old ) for something he didn't do! I'm sick!

Can we appeal this??????

What are the chances of geting the appeal?

Sentencing date Aug.22nd......... HELP!

Re: Appealing a murder conviction

Of course you can appeal. The transcript would have to be ordered and reviewed carefully. The first thing that must be done however, is a motion for a new trial in front of the trial judge. After that (if it is denied), you can appeal. There may be grounds of which you are not aware. If you want to contact me, call 248-353-9400.
