Legal Question in Bankruptcy in Michigan

Chapter 7 and Garnishement

I filed Chapter 7 a couple months ago, went to the Bankruptcy court about a month ago. I was issued a Stay to give to my employer for any people trying to garnishee my wages. I do have some ammendments to file and one of them is a judgement in which the person called my work basically demanding the payroll department to garnishee me and send her the money. They explained to her the execution of stay and that they could not do that, I was under Chapter 7. She was upset to say the least. If she continues to harrass my employer about this, isn't she in violation? Am I correct in saying that my employer cannot give her my wages due to the stay?

Thank you!

Susan

Re: Chapter 7 and Garnishement

Greetings; Yes, you are correct. In fact the individual is violating federal law by trying to collect their debt after they are informed that a stay order exists. If they do not immediately stop, call your attorney and have them take action. Good luck re-building your financial status. Atty. Trichler; www.trichler.com
