Legal Question in Bankruptcy in Michigan
Surrender of residence.
What is the time limit for you to vacate premises when you voluntarily surrender your residence, it is put up for auction and not sold? Do you pay rent or maintain payments to the mortgage company until you legally have to vacate?

I'm not certain what you mean by "voluntarily surrender." Normally, when a house is foreclosed upon, it goes to a sheriff's sale and is sold. The homeowner then has 6 months (or 12 in some cases) to redeem the house for the price of the sheriff's auction. During that time you do not have to pay rent and you may stay in possession until the redemption period ends and the buyer takes you to court to evict you.
