Legal Question in Business Law in Michigan
Broker Agreement with Seller to Receive Refund
I am acting as a dealer without a company name to sell a piece of equipment to an out of state buyer. Using advance payment from the buyer I want to purchase the equipment and resell it to the buyer. The buyer has agreed to that but wants to make his initial certified check or bank wire out directly to the seller organization instead of me.
The amount of his check would be higher than the agreed price between the seller and I. I would like a legal form in which the seller agrees to refund me the difference between the certified check or bank wire to them from the buyer and the price they agreed to give me.
I would also like the form to make it clear that I am the owner. My buyer will become the owner when I deliver it to him.
