Do I have to cancel a gym membership in person or should I be able to do it over the phone? I tried over the phone, but they charged me for three additional months until I showed up in person to cancel. Can they legally do this or do I have any recourse? Thanks.

You need to check the terms of your contract. Most contracts require a cancellation to be in writing. Even if the contract doesn't specify, you should always place communications in writing for your own protection. If you feel they are excessively charging you or violating the Michigan Consumer Protection Act, you should consult a lawyer to discuss your legal remedies. You may also try writing a demand letter stating that you cancelled via phone on X date, pursuant to your legal rights, and, therefore, you want a refund of the monies that were wrongfully charged to you, or you will contact the Better Business Bureau and Attorney General's office for their wrongful actions. Whether they were legally right or wrong depends on the contract. It's worth a shot. Good luck.
