Damages

Lets just say I own a business and I have a contract with a computer software company. They failed to deliver my new software in the time they promised and this caused my company to lose over $75,000 in profits. Am I able to sue for compensatory damages? Thanks in Advance..

This depends on how your contract reads and if it reflects the risk allocation (eg disclaimers, limitations on remedies, limitation on liablilities, liquidated damage provisions) and promises made by the software company.
