Legal Question in Business Law in Michigan
Small claims defendant
I own a water well drilling business (since Feb.'02) and I took a job that my rig was not capable of finishing. I always use contracts however circumstances did not allow one in this case. The laws in Michigan do not allow drillers to remove well casing therefore I charged him a reduced cost for the 4 inch casing that was in the ground. With no contract am I in trouble? The property owner also shot my well rig during deer hunting season with his rifle, breaking a hydrolic line on my rig. Please help asap...I have to be in court March 28, 2003. Thank you

Re: Small claims defendant
Depending on the circumstances, oral agreements can be enforceable. Unfortunately, I need more information. For instance, what was the total cost of the job? Is the customer only suing for the cost of having someone finish the job? Or is there more? Also, were you asked to remove your rig b/4 the customer shot it up during deer season? Finally, the reason for not being able to finish the job might be quite important if it was unavoidable or wholly unexpected.
