Legal Question in Business Law in Michigan

I hired a webdesigner to do 2 websites for me i paid him for one that was basiclly completed and the other i paid half on and he has done half the work but its taking him forever to finish i just want a refund so i can get someone else to do it is there anyway i can do this there is no written contract on this just verbal agreements he lives in mi i live in cali

In order to sue the Web designer in California Small Claims, where the limit is $7,500, you would have to serve him in California. Whether there would be jurisdiction in any California court would also control whether the could be sued in Superior Court. In all probability, you're stuck with suit in Michigan. From an economic point of view, unless there is a lot of money at stake, you're probably better off to just cancel the contract, write off your loss, and get on with things through a local designer, a written agreement and a definite delivery date.
