contract

Recieved a check as a deposit for a furnace install. Customer than asked that check be held a few days ,than said to tear up as they had changed mind. Check noted for furnace job. Is this a contract? Do I have a legal right to this check I am holding?

Re: contract

It would depend on what your estimate/invoice says about it.

If you didn't have an estimate/invoice in writing, the it would depend upon your oral discussions.

If you were under a written or oral agreement that the deposit was non-refundable, then you would likely have a good case for keeping the check. This would be particularly true if you held days open (and missed other work) because your time was booked to the customer.
