Legal Question in Consumer Law in Michigan
Car Accident
I rented a car and returned it to their lot. While on their lot someone else hit the car. There is no question about the facts of the accident because it happened in front of myself and their representative and the person admitted to hitting the car.They say I'm still responsible for the car because they hadn't done a final inspection. I say the car was returned to their lot a nd the key given to their representative prior to the accident so I'm not responsible. Are there any laws covering something like this.

You may still be responsible for the car, but the person hit the car is responsible to you, or the rental company. You would need to make a property damage claim against the driver of the car that hit your rental. Visit www.kliszlaw.com to discuss further. Tim Klisz

Sounds to me like the car rental establishment is trying to muddy the waters. You returned the car and that is no technicality as you handed over possession. Lack of a "final inspection" does not remove the fact that the car was returned and in their possession when hit. Furthermore, they were a witness to the damage. I can't believe a jury would require you to pay for damage to their car in their possession and as to which a third party caused damage in their presence!

Unless your contract with them requires otherwise, the car was parked on their property - and you were done with it. You were there to return it to them. They should have to pay for the damages through their insurance company. It seems like they are trying to pull a fast one on you and get you to pay for something that you likely aren't responsible for.
