if a merchant sells used merchandise as new is he guilty of fraud

most likely, yes, unless there are other facts i'm not aware of. can you return the item at their expense?
there are likely also violations of the michigan consumer protection act that would entitle you to attorney fees and costs if you had to pursue a lawsuit.
