Legal Question in Consumer Law in Michigan

Puppy Mix-up at the pet shop

Yesturday I went to the pet shop to look at puupies. I found a puppy that myself and my son really liked and told the sales clerk I wanted to buy it. She asked me if it was a male or female. I said I didn't know and lifted the puppy up for her to look at. Her boyfriend said it was a male dog and I was charged $50.00 less for the puppy and left the shop. After taking the puppy to the vet I found out it was the female puppy. I then emailed the shop to let them know they sold me the female so that I can get the correct registration papers for the puppy. They called me the next day saying that they sold me the wrong puppy and I need to bring this puppy back or come in and pay more money to keep it. They could not have sold me the wrong dog because I picked the one that I wanted. They made the mistake. I was also told papers would be mailed to me but now am being told I have to come back up there to pick up the papers. Do I have to give the puppy back or pay more to keep her? My kids and I are all very fond of her. Thank you

Re: Puppy Mix-up at the pet shop

Based on the facts you have related and assuming that the puppy you took home is the puppy that both you and the pet store inspected, the puppy is yours. Yes, the pet store made the mistake, and was in the position to know better. If you have any further questions or problems, please contact me at www.lawgreg.com. Best of luck.
