Legal Question in Consumer Law in Michigan
I purchased face cream for shipping and handling only. When I did not call within the trial period, which I didn't know about, they slapped me with $89.95 a bottle and I received two different items. They said that they will take me out of the renewal program, but won't refund the money for the items. Even if I return them because I didn't call within the 14 day trial period. I have not used or even opened the actual items, but I did open the shipping container to get their contact information when I found the charges because my debit card was declined. I already talked to the manager and they won't do anything. Is there anything I can do about this? Thank You for your time and help, Tracy Watson

File a complaint with the FTC. In the 1990's a big political change was made in Michigan. That governor appointed many conservative justices. These justices carved out a huge loophole in the Michigan Consumer Protection Act for businesses that are 'regulated'. Because of that you cannot assert a claim under the MCPA which would make is economical for you to hire a consumer protection attorney to assist you. Besides not voting Republican, which is what this actually comes down to, you can file a complaint with the FTC. Yes, you could hire an attorney to pursue this but it would cost you a lot of money. The FTC has lot of rules you can search for online to find to see if this company was fully compliant.
