get collectors to stop calling dad's house for son's debt (he resides there)

Can I get a company trying to collect a debt from my son (age 26) to stop calling my house? My son resides with me and he gave them the number. He has acknowledged the debt to them and told them of the payment schedule that he can afford. They have ignored his terms and continue to call. Since this is my home, everything is in my name, I consider their repeated calls a nuisance to me. The debt is for a car insurance premium that he wasn't even aware of the obligation because of an automatic deduction from a bank account that was empty, but they insured him anyway, and charged him.

Yes, you can stop them from calling. Next time they call, ask for the address and write them a letter specifically demanding that they stop calling your home and that all future correspondence be in writing. Once you get the address, tell them directly AS WELL that they are to stop calling your home.

They will probably threaten to sue, which is their option. If you dispute the debt, put the reason why in your letter. However, an empty bank account is NOT a good excuse if your son entered into a contract. It's not the other side's problem that he didn't fund the bank account as he promised to do.

Your son can make his payments and take his chances with a future lawsuit. The business to which he owes the debt (as opposed to the debt collector) cannot refuse his payments, because they have an obligation to reduce their damages.
