Legal Question in Credit and Debt Law in Michigan

Mu husband went to use our debit card yesterday afternoon. He found out it was declined. He went to our bank and said a law firm has our account on hold. He tried to call the law firm but received no response as it was 4:30 pm on. Friday afternoon. Now we have no money. What do we do?

Call on Monday. They clearly have a judgment against one or both of you and you'll need to find out more. Get an attorney on board if needed.

You were probably sued in another jurisdiction where you used to reside. Have you moved much in the last 5-10 years? Did you file change of address notifications with the post office? Sometimes even if you have if you have not kept up with your creditors they will use an old address and sue you there. So you need to call an attorney that has access to some databases that can check for judgments or you need to go to annualcreditreport.com and get a copy of all three credit reports separately. You should be able to find the judgment there. Unless you have a good defense to that debt, however, it may be difficult to get out of the judgment. There are ways to stop garnishments as long as you agree to a reasonable payment plan through the court (not through the creditor). You need an attorney to look at this to ensure that the law firm that appears to have sued you has complied with the Fair Debt Collection Practices Act by suing you in the proper venue.
