We were paying $150 a month for a credit card bill. We sent our payment faithfully for two years directly to the credit card company, and our balance at the end of 2000 was down to approx. $2,100. When I went to make a phone payment in the latter part of 2000, we were then told that our payments should be sent to the lawyer's office that was handling this case. We received a letter from them which stated that our balance was over $8,000! I called and told them that I didn't agree and wanted a letter with the corrected total. They never sent it, so I didn't send another payment. Apparently there were problems with the credit card company, and now some old accounts have been bought by another company. Now, lo and behold 2 years later, this lawyer's office calls us and says that we can settle for $5,000 or if we choose to keep our original payment plan, then our balance is over $8,000! We feel they are at fault as they didn't do their job, and they want us to pay for their mistake. We know we owe the $2,100 but $5,000-$8,000? Now they claim that the letter with our balance on it was sent in error as it was from another account, one that we paid in full in February of 2000; and they sent this to us in December of 2000!

You should retain an attorney to go over your records and to make sure that records of the debt are properly accounted for. If it is their mistake, it should be fairly easy to sort out.
