Legal Question in Credit and Debt Law in Michigan

out of state judgment

I have a Small Claims judgment on a California individual that moved to Michigan. How do I proceed in getting my judgment registered, so I can obtain a writ of execution? Also how do I obtain an abstract of judgment and how do I go about recording an abstract of judgment against any real property?

Sheldon:

You will have to apply to a court in Michigan for what is called here a "sister state judgment". After the court approves the judgment there, you may begin to take any steps necessary to collect a judgment, including garnishing wages, seizing bank accounts, and/or putting a lien on property.

I am not a Michigan attorney, so I can't offer you advice or tell you what the procedure is there regarding an abstract of judgment.

Here in California, however, an abstract of judgment is prepared and certified with the court where the judgment was entered, and then recorded in the county recorder's office for EACH county that you believe the person has property in.

That puts any future transactors on notice that there is a judgment.
