Legal Question in Criminal Law in Michigan

15 year old charged with aggravated assault

After putting up with bullying and harassment all year at school, my son finally had enough I think, and took matters into his own hands, while being harassed by 8-10 other boys and girls in a group, he hit one in the nose and broke it (which is not my sons normal actions) now the prosicuting attorney is charging him with agravated assault. How much does my son have to endure. I need to know what can be done to help my son??

It sounds like your son may have a solid defense. Self-defense is an absolute defense. You must realize that agg assault is a serious crime and needs to be addressed. Your son has a great case, if it's truly a matter of self-defense. The problem is that a lot of the kids might stick up for one another and falsely report that he was the aggressor. No matter--just a couple witnesses on your son's side may create all the "reasonable doubt" a jury needs to acquit--if it were to go that far! But certainly there's a lot that can be done. In fact, with all the hype these days about Columbine and bullies and that sort of thing, I'm surprised the prosecutor is siding with the bullies.
