If my passenger possess Marijuana, can I be charged?

You can always be charged. Getting convicted is another matter. Put it this way. If you were honestly surprised that your passenger had marijuana, probably no conviction. If you drove him to the drug house and he had it on him when you both were stopped at the scene, you'll both be convicted.

In between those two extremes (he threw it under your seat, you're both stoned, he says it's all his so you won't violate your probation or he says you put it under his seat so he won't be VOP, the car reeks of weed, etc.) the likelihood of you being convicted depends on the circumstances.

Most first timers know they're not innocent and plead under sec. 7411 to avoid the risk of having a record.
