Legal Question in Criminal Law in Michigan

Is it possible to file assault charges against a school bully? Would there need to be witnesses? Is it possible to file a restraining order against the same bully? If so, would I need to pull my kid out of that school to be granted the order?

The decision whether to press criminal charges is made by the prosecutor. There would not necessarily need to be witnesses, but it would certainly help your cause if you had some documentation of the bullying (e.g., pictures, acknowledgement by school staff). I don't know the answer to either restraining order question. Aside from the possibility of criminal charges, if the bullying is severe and the school has knowledge of it but does nothing to stop it, it may be worth contacting a personal injury attorney to discuss the possibility of legal action against the school. You can request a Personal Protection Order from the Circuit Court. This will have the same effect as a restraining order.
