Legal Question in Criminal Law in Michigan

Inmate has filed a motion on his own. I called the court today and although they have my letter which was mailed the same day, they claim to not have my husbands/inmate motion i sent along with it. Do they accept motions prepared by an inmate at Frank Murphy Hall of justice? Should I resend it? He's been incarcerated for 17 of his 25 yr sentence and now is seeking time served and one other motion that I fail to remember the name. Did the judge discard it because it came direclty from the inmate?

Inmates can certainly file motions if they are a party in a case.

If you have no lawyer, the best way to file a motion is to make 3 copies. Send a copy to the prosecuting attorney and record the date you sent them on the remaining 2 copies.Then, hand deliver the remaining copies to the criminal court clerk who will time stamp the documents and keep the originals. Keep a copy for yourself.

After a few days have passed, contact the court to determine when the motion hearing is scheduled.
