Both are misdemeanors.

Retail Fraud 3rd degree carries up to 93 days jail and/or $500 fine and requires proof that the person stole less than $200 of merchandise for sale from a store that was open for business at the time (or did a price-switch of that amount).

Retail Fraud 2nd degree is a misdemeanor carrying up to 1 year jail and/or $1,000 fine and involves EITHER a Retail Fraud 3rd Degree fact pattern where the defendant has a prior larceny conviction, OR circumstances where the defendant stole $200 or more but less than $1,000 in merchandise from a store while it was open for business (or did a price-switch of that amount).

FYI: Retail Fraud 1st Degree is a felony (5 yrs and/or $10,000) where the defendant steals $1,000 or more ... or ... steals $200-$999 and has a prior larceny conviction.
