Legal Question in Criminal Law in Michigan
shop lifting
my son was caught shop lifting from Kmarts he was 18. he signed something saying he would pay a fine because he was scared the police would be called. he made one payment of $85.00 before I found out. he left the item at the store which was only a $20.00 item. I don't condone this but this boy has never had as much as a parking ticket and has never been in any trouble of any kind, he graduated high school with good grades and always worked a full time job.he didn't want the knife and he could have purchased it if he wanted to. he and a couple of friends wanted to see if they could get away with it.The police where never called and I feel that $85.00 is enough to be paid by him.I'm glad he was caught because it scared him and he will never do it again. I told all this to a law firm that keeps bothering him to pay the balance of $450.00 and I told them NO! he will not pay anymore. My question is if he was 18 and signed something (he was scared and doesn't know what he signed)does he still have to pay the balance of $450.00 that includes attorney fees (why he ha sto pay attorney fees I don't know) police where never called and there was no court.

Let me guess, this is a Florida law firm, isn't it?
By Michigan state law your son (not you) are liable for $200 and no more.
Since K Mart didn't have him arrested, it's doubtful it would sue an 18 year old for $200.
