Legal Question in Criminal Law in Michigan

testifying against husband

I am going through menopause, have severe panic

attacks and one night I was not feeling well, drank a

little too much and brought on a bad panic attack.

Sister was on cell phone, heard me yelling, called

police. police arrested my husband for domestic

violence because I was hysterical and had red marks

on my chest, which were caused by me trying to catch

my breath and falling on floor. My husband never

touched me. He has been incarcerated 4 mo. Can

prosecutor use 911 call from my sister and pictures

against my husband?

Re: testifying against husband

What is the amount of your husband's bond?

Has he ever been arrested for this before?

Since the maximum for Domestic Assault is 93 days, 4 months indicates he has a prior assaultive record.

In most cases, the prosecutor can use your sister's 911 call. The photos of you are admissible.
