Legal Question in DUI Law in Michigan

20 years of experience down the drain?

I have a driving while impaired by alcohol offense on my driving record (non-commercial, less than .04 alcohol content, 4 pts. on my license, received while licensed in New York 2 years ago). I am a licensed CDL, professional OTR Driver with over 20 years of experience. I have never had any other major citations; never been in any accidents; am a reputable driver. I was told this would not affect my CDL, it didn't. . . but it has affected my ability to obtain gainful employment because most trucking company insurers refuse to cover me. Is there a way to block this information from appearing on my MVR and DAC reports?

Hello, I have received a copy of your e-mail regarding your CDL. There is no way to block the conviction from appearing on your record. All that I can suggest is that you consult a New York attorney in the same location as your conviction and see if it is possible for the conviction to be changed o a non-alcohol conviction. It is probably unlikely, but it can't hurt and possibly the judge may allow it for equitable reasons since you have already served whatever sentence occurred as a result of the conviction. Good Luck.
