Legal Question in DUI Law in Michigan

Careless driving and PBT refusal in MI, CA license

I was pulled over in Michigan for ''a busted tail light.'' I tried to blow hard enough at the roadside sobriety test(but didn't) and was taken to the station. There I was given another sobriety test where I got .06. I was released but given a ticket for Careless Driving & refusing to take a PBT test, and not allowed to drive home.

Is the careless driving because of something that I did, or because I was driving with a BAC of .06?

Will the points find their way on to my California license? What happens if I do/don't pay?

I've scheduled a hearing in 2 weeks, any advice?

You got lucky. Careless driving is a civil offense - not a crime.

If you want, an attorney can probably get the PBT charge dropped, but a review of your driving record would help to decide.

Yes, points, if you're convicted, will go on your California driver's record.

If you don't pay or don't show up in court, a warrant will issue for your arrest. Don't do that. This is not that big of a deal.

Plead not guilty at your arraignment and you will get a pretrial date.

I'd be very cautious about trying to do this yourself without an attorney.
