Driving without a license
My husband was caught driving on a revoked license. He lost his license due to DUI's. He lost it for 5 years and was eligable to get it back in June 2003. This is his 2nd time being caught without a license. He was not drinking. He had an arrignment today and had to plead guilty because the judge wants him to do 90 days in jail. We are having a court appointed attorney help him. Do you think that jail time is correct. What are some things to help him get out of this - he was working the day he got caught, has a good job and can't afford to lose it over something so stupid. He was pulled over for failure to yeild to a yellow light.

So are you saying that because he had to work and drive to get there, he should have a defense? The facts show that he has no valid license. It's not likely that he'll do jail time, but the possibility exists since the offense carries a 93 day jail sentence. Most judges look to the defendant's prior record. If he has multiple counts of the same offense, he's in real trouble. The fact that his suspension/revocation is because of alcohol-related offense is a real minus. He needs an attorney to do damage control, and no guarantees go with that. My advice is get an attorney involved asap.
