5 hour ''rule'' regarding custody time

My ex-wife and I have written in our decree that if one parent shall be away for more than a 5 hr period, the other parent must call, ''act of first refusal''...there is NO specific language regarding an overnight stay with a grandparent. My ex contends that if I leave our son overnight with a grandparent, that violates the agreement we have...I disagree of course...am I allowed to have our child stay overnight with a grandparent without violating this clause ?
