Legal Question in Family Law in Michigan

appealling my divorce judgement

I would like to appeal the ruling of my divorce. I wanted to know first if I could and second if I have a deadline to do so. Like a lot of other men I let my ex-wife walk all over me even though I caught her having an affair. Help!

Re: appealling my divorce judgement

You haven't stated, either, whether this was a judge-imposed judgment or a consent judgment (settlement).

It's amazing how often people let their emotions get in the way of a decent divorce judgment, only to come to their sense later and realize they didn't look out for themselves. It's far too easy to blame the ex-spouse than to take responsibility. So stop it. :o)) That way, you'll be able to think more clearly.

If you are within the appeal period for Michigan (generally 21 days), I suggest getting in there immediately and lodging your appeal to preserve your rights. Just know that absent a particularly strong reason, you'll not get a consent judgment overturned or modified.

Most appellate attorneys require payment up front for precisely that reason.

Re: appealling my divorce judgement

As another attorney has indicated, the time in which to appeal a divorce judgment is short. Absent an appeal, most provisions in a divorce judgment are final. However, child custody, support and parenting time are modifiable in Michigan. Hope this helps.

Re: appealling my divorce judgement

It is unclear as to whether the divorce was in KY or MI. If in KY, you have 20 days from the date the decree was entered by the court clerk to begin the appeal process.
