Legal Question in Family Law in Michigan
Change in Amount
The father of my child bought a brand car, moved out of his parents house and in with his girlfriend and had to start paying insurance on his car between Sept & Oct. Our support agreement was established two years ago, but a judge raised the amount last year in Januarry. He is now trying to get it lowered because of financial strains that are his own fault. He listed his expenses on the request for change paper and I know he lied about the expense of rent; he claims he pays all of it when in fact his girlfriend pays half. He is also getting married in july so thats adding strain. His insurance is high because he was drunk and wrecked his truck that he didnt have insurance on a couple years ago. Ok I am rambling. Basically how can he spend all this money then decide he cant afford childsupport? I am not going to agree to letting him change it because I feel like 1)he knew what his expenses were 2) he could have gotten a more affordable car 3)I dont think its fair that because he is getting married he feels he is no longer soley responsible for childsupport. What questions should I ask and should I bring up all these things at the hearing ?

Re: Change in Amount
His living expenses do not have much bearing except to the extent that there is some extraordinary expense such as unforseen medical bills etc. Child support should continue. His tough luck. See your attorney or your local child support office.
