Child Cusstody

My daughter is 16. According to my divorce decree she is to live with her father 6 months out of the year. She is currently living with her dad. She said she is going to refuse to live with him anymore. What are the ramifications for her and myself if she does not go back to her father's house.

You should file a motion to modify the original custody order, especially if you want to receive child support since she will be with you more than 50% of the time. The court should and most likely will let your daughter make the decision as to where to live. Hopefully the father will not dispute it, as long as you provide him with reasonable visitation.

They may file a motion to force the issue of visitation. You may want to hire a lawyer and modify the original order.
