what do i needto provide to get custody of my nephew an his mother is in tx an he's here with me?

You need to obtain custody in the state where the minor resides. If the mother and father do not object, that will make it easier. You will need to file a petition with the probate court to obtain guardian over him. All "interested parties", i.e., his parents, need to be notified of the petition and hearing.
