Legal Question in Family Law in Michigan
child support was lowered.
I asked for a modification of child support & found out my x has been employed for $40,000 per year 2X's what I make. He informed referee he was now unemployed. The friend of the court lowered his support to $69.00 for 2 children from $125.00. I went before a judge and asked to have it put to a fair amount of 204.00 per week stating he has the ability of a skilled trade to gain employment again and that he lied to the court for 1 &1/2 years saying he worked in a fruit market for $6.00 per hour. What can I do next to get support back to afair amount for 2 teens.

Re: child support was lowered.
We have received a copy of your message regarding past child support. You do not mention what state you are in. I am replying with the assumption that it is Michigan.
Michigan law normally requires a claimant to make a "timely" demand for child support review and will not require a parent to pay additional support retroactively to a point in time prior to the filing of a request for a support change. There is an exception to that if a person commits fraud and fails to file accurate information. Then the court MAY exercise it equitable powers to require retroactive payment as a result of the deception on the Court.
