Legal Question in Family Law in Michigan

Complaint withdrawal

My husband and me had fight 3 days ago, and there was some scuffling also involved. In the heat of the moment, I called the police, and got my arrested, eventhough he left our place within two minutes of the fight.

Now, I want to withdraw my complaint, as this is not what I wanted. I just wanted that police give im a warning. I went to officer who is looking into our case, and also to attorney. But, both of them are not helping in withdrawing my complaint. My daughter is suffering from all these, as she is very attached to her father, and he has to stay away from us.

Thanks in advance.

Re: Complaint withdrawal

Unfortunately, it is not that easy. Because police do not like to be called to domestic disturbances and risk their lives only to have the wife have second thoughts after they stuck their necks out, the legislature passed a law allowing the police to bring the action on their own and then subpoena the wife as a witness. If you did not show, then you are held in contempt. If you change your story, then they charge you with making out a false police report. Therefore, before a spouse calls the cops, some thought should be given to the repercussions. Now, just sit back and face the ramifications of your actions. William S. Stern
