do i have to give my baby to his father on the weekends it is not court ordered he is not on the birth certificate it is not safe over there

If there is no Court Order directing that either party has custody, visitation etc then each parent has an undivided equal interest in the minor child. This causes a lot of problems because it literally means that each parent has unlimited rights to the minor child. What this means for you is that you do not have to take your child to visit with the father. You can literally not have the child involved in the father's life at all, but this ability cuts both ways. The father also has freedom to do whatever with the minor child so he could literally take the child and keep them from you. I strongly recommend that you hire an attorney that specializes in Family Law to first establish Paternity in the man you think is the father, and then seek to establish custody with yourself and parenting time and child support for the father.
