Legal Question in Family Law in Michigan

Motion in Michigan for Custody, we live in California

Hi

My wife and I have had custody of her grandaughter for six of the past six and one-half years. The mother was unable to care for her daughter.

The Mother has had little contact with her daughter, but filed a Motion in Michigan for custody (we lived there when guardianship was awarded, but have been in California for four years).

Question: Although we did file an Respone (Pro Per) to the Motion. Do we have to attend, or be represented by an attorney in order for the Judge to consider our Response?

It is definitely a good idea to have an attorney appear for you. If you don't appear, the only thing the judge has to go on is your written response. Custody issues tend to require hearings.

Yes, it is absolutely necessary that you appear in order to prevail. You do need a lawyer as well.
